Slovak Constitutional Court Issues Groundbreaking Legal Capacity Decision
8 January 2013
The Slovak Constitutional Court issued a decision on 28 November 2012 finding violations of the rights of a person with a psycho-social disability who was deprived of legal capacity in the first case brought by MDAC before Slovakian courts.
The Constitutional Court found violations of articles 6 (right to a fair trial), 8 (right to private life) and 14 (right to be free from discrimination) of the European Convention on Human Rights and of Article 12 (the right to legal capacity) of the Convention on the Rights of Persons with Disabilities.
MDAC has just received the full decision, which has not yet been made public, and will post the decision and a translation in English as soon as it is available.
